1. Basic Provisions

1.1 The following business terms apply to all contracts concluded between you, as the customer, and us, MONDO NEGRO, as the supplier, through the website www.mondonegro.com. Unless otherwise agreed, the inclusion of your own terms and conditions is excluded.

1.2 A "consumer" is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. A "businessman" refers to any natural or legal person or a legally responsible partnership that enters into a legal transaction in the exercise of their trade, business, or profession.

2. Conclusion of the Contract

2.1 The contract pertains to the sale of products. We sell the products under our name on behalf of third parties, acting as commission agents. In this capacity, we are contractual partners, holding all associated rights and responsibilities.

2.2 By placing products on our website, we provide a binding offer to conclude a contract under the terms specified in the item description.

2.3 The contract is concluded through the online shopping cart system as follows:

• You place the desired items into the shopping cart.
• You proceed to the checkout page, entering personal information and selecting payment and shipping options.
• Before finalizing the order, you can review and modify the details.
• By submitting the order, you accept our offer, resulting in a binding contract.

2.4 Order processing and transmission of all necessary information for contract conclusion occur via email in a partially automated manner. Ensure that your email address is correct and that you can receive emails from us.

3. Special Agreements Related to Payment Methods

We offer multiple secure payment methods to ensure flexibility and convenience:

3.1 Payment via Credit/Debit Cards
We accept major credit and debit cards including Visa, Mastercard, American Express, and Maestro. Payments are securely processed through Shopify Payments, our e-commerce provider.

3.2 Payment via PayPal
PayPal is available for safe and fast checkout. You can use your PayPal balance, linked bank account, or card through the PayPal platform.

3.3 Payment via Eupago (Regional Options)
We partner with Eupago, a certified third-party provider, to offer the following region-specific payment methods:

• MB WAY (Portugal)

• Bizum (Spain)

• Pix (Brazil)

These options allow for secure mobile or instant transfers. To use these, follow the prompts during checkout.

3.4 Payment via Multibanco and Other Local Methods
Through Eupago or Shopify Payments, we also support Multibanco and other EU-compliant payment methods depending on your location.

All transactions are encrypted and processed in compliance with applicable regulations, including PCI-DSS, PSD2, and GDPR standards.

4. Right of Retention, Reservation of Proprietary Rights

4.1 You may only exercise a right of retention if the claims arise from the same contractual relationship.

4.2 The goods remain our property until the full purchase price has been paid.

5. Warranty

5.1 Statutory warranty rights apply.

5.2 As a consumer, you are encouraged to check the product for completeness, visible defects, and transport damage immediately upon delivery and to notify us and the shipping company promptly. Failure to do so will not affect your legal warranty claims.

5.3 If any characteristic of the goods differs from the stated requirements, the difference will only be considered accepted if we informed you about it before you submitted your contractual declaration and if the deviation was explicitly agreed upon by both parties.

6. Choice of Law, Place of Fulfilment, Jurisdiction

6.1 Portuguese law applies. This choice of law applies to consumers only if it does not revoke the protections guaranteed by mandatory provisions of the law in the country where the consumer usually resides.

6.2 If you are a businessman, a legal entity governed by public law, or an institutional fund subject to public law, our place of business serves as the place of jurisdiction and fulfilment for all services related to the business relationships with us. This condition also applies if you do not have a general place of jurisdiction in Portugal or the EU, or if your place of residence or usual residence is unknown at the time legal proceedings begin. This does not affect your ability to approach a court associated with a different jurisdiction.

6.3 The UN Convention on Contracts for the International Sale of Goods does not apply.

3.2 The complete text of the contract is not stored by us. Before submitting your order using the online shopping cart system, you can print or save the contract details electronically. After receiving your order, we will send you an email containing the order details, the legally required information related to distance selling contracts, and our standard business terms.
